Welcome to TravelCMS. These Terms and Conditions ("Terms") govern your use of our travel content management system and services. By subscribing to TravelCMS, you agree to be bound by these Terms.

1. Service Overview

TravelCMS provides a specialized content management system and search engine designed for travel agencies, featuring curated tour content, real-time pricing, and customizable website solutions.

2. Service Availability and Uptime

2.1 Uptime Commitment

We strive to maintain 99% uptime for our services. While we make every effort to ensure continuous availability, occasional maintenance windows and unforeseen circumstances may affect service availability.

2.2 Maintenance

Scheduled maintenance will be performed during off-peak hours where possible, with advance notice provided when feasible.

3. Content and Data

3.1 Content Updates

Our tour content database is updated daily to ensure you have access to the most current information available from our supplier network.

3.2 Content Accuracy

Tour content, including itineraries, pricing, availability, and descriptions, is provided directly by our suppliers. While TravelCMS makes reasonable efforts to ensure data accuracy and reliability, the ultimate responsibility for content accuracy lies with the respective suppliers. TravelCMS does not guarantee the accuracy, completeness, or timeliness of supplier-provided information.

3.3 Content Usage

You may use the provided content solely for your authorized business purposes as a TravelCMS subscriber. Content may not be redistributed, resold, or used for any purpose outside of your TravelCMS subscription.

4. Subscription and Billing

4.1 Payment Method

All subscription fees are charged monthly in advance via credit card. You authorize TravelCMS to charge your designated credit card for the upcoming month's subscription fee.

4.2 Minimum Subscription Period

TravelCMS subscriptions require a minimum commitment of 12 months from your initial subscription date. After the initial 12-month period, your subscription will automatically continue on a month-to-month basis unless cancelled.

4.3 Pricing

  • First 12 months: $45 AUD per month
  • Ongoing (after 12 months): $79 AUD per month

4.4 Setup Fee

There is no upfront setup fee for new subscriptions. However, if you cancel your subscription within the first 12 months, a $400 AUD setup fee will be charged to recover our onboarding costs.

5. Cancellation Policy

5.1 Early Cancellation

If you cancel your subscription within the first 12 months, you will be required to pay the $400 AUD setup fee, which will be charged to your designated credit card.

5.2 Cancellation After 12 Months

After completing your initial 12-month commitment, you may cancel your subscription at any time with 30 days written notice. No additional fees apply for cancellations after the minimum commitment period.

To cancel your subscription, please contact our support team in writing via email.

6. Account Management

6.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6.2 Authorized Users

You may designate authorized users within your organization to access your TravelCMS account. You remain responsible for all activities performed by your authorized users.

7. Intellectual Property

7.1 TravelCMS Platform

The TravelCMS platform, including its design, functionality, and proprietary technology, remains the intellectual property of TravelCMS.

7.2 Your Content

You retain ownership of any content you upload or create within the TravelCMS platform, including your branding, custom content, and agency-specific materials.

8. Limitation of Liability

TravelCMS provides services "as is" and makes no warranties beyond those expressly stated in these Terms. Our liability is limited to the amount paid by you in the 12 months preceding any claim.

9. Support and Training

9.1 Technical Support

We provide technical support for platform issues and respond to support requests within 48 hours during business days.

9.2 Training

Initial setup includes comprehensive training, with ongoing support available through our video library and additional training sessions as needed.

10. Modifications to Terms

TravelCMS reserves the right to modify these Terms at any time. We will provide 30 days notice of any material changes. Continued use of our services after modifications constitutes acceptance of the updated Terms.

11. Geographic Availability

TravelCMS services are currently available exclusively in Australia and New Zealand.

12. Termination

TravelCMS may terminate your subscription for breach of these Terms, with appropriate notice and opportunity to remedy where applicable.

13. Governing Law

These Terms are governed by Australian law, and any disputes will be resolved in Australian courts.
